VENDOR TERMS AND CONDITIONS
Effective Date: 26 April 2025
Applicable To: Travel Agents, Hoteliers, Homestay Operators, Ticketing Providers, and Umrah Package Operators
Please read these Vendor Terms and Conditions carefully before registering or listing any product on the Beli Holiday platform. By registering as a vendor, you agree to be bound by these terms in their entirety.
1. Introduction and Acceptance
These Terms and Conditions ("Vendor Agreement") govern the relationship between Beli Holiday (operated under the brand "Beli Holiday" and accessible at beliholiday.com) and you, the Vendor ("you", "your", or "Vendor"). By registering, listing, or maintaining any listing on the Beli Holiday platform, you agree to be fully bound by these terms.
Beli Holiday is a travel listing marketplace based in Malaysia, designed to connect travel agents, hoteliers, and homestay operators with potential customers. Beli Holiday is a listing platform only and does not process, handle, or facilitate any booking payments or financial transactions of any kind.
If you do not agree to these terms, you must not register or maintain a vendor account on this platform.
2. Nature of the Platform
Beli Holiday operates exclusively as an online listing marketplace. The platform serves as a directory and advertising medium that allows vendors to showcase their travel products, packages, and services to users visiting the website.
Beli Holiday does NOT:

Process or handle any booking payments on behalf of vendors or customers.

Collect or transmit any transactional funds between vendors and customers.
-
Act as an agent, intermediary, or representative in any financial or booking transaction.

Set, recommend, or influence the pricing of any listed product or package.
-
Guarantee or warranty the availability, quality, or accuracy of any listed product.

Mediate, adjudicate, or resolve any dispute between vendors and customers.
All transactions, bookings, communications, and payments between vendors and customers occur entirely outside the Beli Holiday platform, primarily through WhatsApp or direct brand channels. For hotel and resort brands, customers may be redirected to the vendor's official brand landing page for further details and bookings.
3. Vendor Eligibility and Verification
To become a listed Vendor on Beli Holiday, you must satisfy the following eligibility requirements:

You must be a legally registered business entity or individual operating lawfully under Malaysian law or the applicable jurisdiction where your business is registered.

Travel Agents must hold a valid licence issued by the Ministry of Tourism, Arts and Culture Malaysia (MOTAC) or the relevant licensing authority.

Hotels, resorts, and homestay operators must hold all applicable permits and registrations required by Malaysian law.

Vendors offering Umrah packages must hold valid accreditation from Tabung Haji or the relevant Malaysian authority.
-
Vendors selling outbound travel packages must comply with applicable consumer protection and licensing laws.

All vendors must submit valid supporting documents during the onboarding process.
Beli Holiday conducts verification checks on all vendors prior to onboarding. However, verification does not constitute an endorsement, guarantee, warranty, or certification of the vendor's services, quality, or financial standing. Beli Holiday reserves the right to reject any vendor application at its sole discretion without providing reasons.
4. Listing Content and Accuracy
All information, descriptions, pricing, images, itineraries, inclusions, exclusions, and any other content published on the Beli Holiday platform are entered solely by the Vendor.
Beli Holiday does not create, edit, verify the accuracy of, or take responsibility for any content submitted by vendors. As a Vendor, you represent, warrant, and agree that:

All content you submit is true, accurate, complete, and not misleading in any way.

You have full legal rights, licences, and permissions to use all content submitted, including images, logos, descriptions, and promotional materials.

Your listed prices are set entirely by you and reflect your own commercial decisions.

Your listings comply with all applicable Malaysian laws, including consumer protection regulations and advertising standards.

You will promptly update any listing content that becomes inaccurate, outdated, or misleading.

You will not submit content that infringes upon intellectual property rights of any third party.

You will not use the platform to conduct fraudulent, deceptive, or unlawful activities.
Beli Holiday reserves the right to remove or suspend any listing that it reasonably believes violates these terms or applicable laws, without prior notice and without liability to the Vendor.
5. Product Categories
Beli Holiday supports listings across the following travel product categories. Vendors may only list products within the categories for which they hold the appropriate licences and authorisations:

Inbound Travel Packages — Tours and packages for travellers visiting Malaysia.

Outbound Travel Packages — Tours and packages for Malaysian travellers travelling abroad.
-
Ticketing — Flight, event, attraction, or transportation ticketing services.
-
Umrah Packages — Umrah pilgrimage packages for Malaysian travellers. Must be offered by duly accredited operators.

Hotel and Resort Listings — Room offers, promotions, and packages by hotels and resorts in Malaysia.
-
Homestay Listings — Accommodation listings by registered homestay operators.
Beli Holiday reserves the right to expand, modify, or restrict available listing categories at its sole discretion.
6. Revenue, Fees, and Advertising
Beli Holiday generates its revenue exclusively through advertising and promotional services offered to vendors. These include:

Ad Posting — Paid placement of promotional content on the platform.

Media Solutions — Content creation, banner advertising, and digital marketing packages.
-
Boost Ads — Enhanced visibility and promoted listing services.
Beli Holiday does NOT charge any commission, transaction fee, booking fee, or service charge based on the value of any package, offer, or transaction conducted between a vendor and a customer. Any fees paid to Beli Holiday are strictly for advertising and promotional services and are entirely separate from any vendor-customer transaction.
All advertising fee arrangements are governed by separate agreements between Beli Holiday and the Vendor.
7. Transactions and Payments
All bookings, reservations, and payments between Vendors and customers are conducted entirely outside of the Beli Holiday platform. Beli Holiday has no involvement in, visibility of, or responsibility for any such transactions.
Vendors are solely responsible for:

Issuing legally compliant receipts, invoices, and booking confirmations to customers.

Collecting payments through their own payment channels.
-
Honoring the terms, conditions, pricing, and inclusions as stated in their listings.

Providing all contracted services to customers as advertised.
-
Complying with all applicable tax obligations, including GST, SST, or any other applicable taxes.

Maintaining accurate records of all transactions.
8. Communication with Customers
All communication between Vendors and customers takes place outside the Beli Holiday platform. The primary channel of communication is WhatsApp, where customers will be directed upon expressing interest in a vendor's listing. For hotel and resort brands, customers may be redirected to the vendor's official brand landing page for further enquiries and bookings.
Vendors are responsible for ensuring timely, professional, and transparent communication with all enquiring customers. Beli Holiday bears no responsibility for any miscommunication, misrepresentation, or failure to communicate that occurs between vendors and customers outside the platform.
9. Disputes and Complaints
Beli Holiday is a listing platform only and does not mediate, investigate, arbitrate, or resolve any disputes, complaints, misunderstandings, or disagreements between Vendors and customers.
All disputes arising from any transaction, booking, payment, service quality, or communication must be resolved directly between the Vendor and the customer. Customers wishing to raise complaints must contact the individual Vendor directly.
By listing on Beli Holiday, you as a Vendor acknowledge and agree that:

Beli Holiday has no obligation to intervene in any vendor-customer dispute.

Beli Holiday shall not be held liable for any loss, damage, or harm arising from disputes between vendors and customers.

You will handle all customer complaints and disputes responsibly, promptly, and in good faith.
10. Vendor Obligations and Conduct
As a Vendor on Beli Holiday, you agree to at all times:

Maintain valid licences, permits, and accreditations required to offer your listed products.

Ensure all listings are kept accurate, current, and compliant with applicable laws.
-
Not engage in any misleading, deceptive, fraudulent, or unethical conduct towards customers.
-
Treat all customers with professionalism, fairness, and respect.
-
Notify Beli Holiday promptly of any changes to your business registration, licence status, or the nature of your business.

Comply with all applicable Malaysian laws, including the Tourism Industry Act 1992, Consumer Protection Act 1999, and Personal Data Protection Act 2010.
11. Suspension and Termination
Beli Holiday reserves the right, at its absolute discretion and without prior notice, to suspend, remove, or permanently terminate any vendor listing or vendor account in circumstances including but not limited to:

Submission of false, misleading, or fraudulent information during registration or listing.

Failure to maintain valid licences or regulatory compliance.
-
Repeated or serious customer complaints.
-
Conduct that Beli Holiday reasonably deems to be damaging to the reputation or integrity of the platform.

Breach of any provision of these Terms and Conditions.
-
Violation of any applicable Malaysian law or regulation.
Termination of a vendor account does not relieve the Vendor of any obligations owed to customers with existing enquiries or bookings made prior to termination.
12. Intellectual Property
You retain ownership of all content you submit to Beli Holiday. By submitting content, you grant Beli Holiday a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your submitted content solely for the purpose of operating and promoting the Beli Holiday platform and its associated marketing channels.
You must not submit any content that infringes the intellectual property rights of any third party. Beli Holiday reserves the right to remove any content upon receipt of a valid intellectual property infringement notice.
13. Privacy and Data Protection
Beli Holiday collects and processes vendor data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia. By registering as a vendor, you consent to the collection and processing of your personal and business data as necessary for the operation of the platform, including verification checks, communication, and administrative purposes.
Beli Holiday will not sell or share vendor data with third parties for commercial purposes without your consent, except as required by law or as necessary for the operation of the platform.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Beli Holiday, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

Any transaction, booking, or payment between a Vendor and a customer.

Any dispute, miscommunication, or dissatisfaction between a Vendor and a customer.

Any inaccuracy, error, or omission in vendor-submitted listing content.
-
Any interruption, suspension, or termination of the platform or a vendor's listing.
-
Any loss of business, revenue, or reputation suffered by a Vendor as a result of using the platform.
Beli Holiday's total aggregate liability to any Vendor, regardless of the cause of action, shall not exceed the total amount of advertising fees paid by the Vendor to Beli Holiday in the three (3) months preceding the event giving rise to the claim.
15. Amendments to These Terms
Beli Holiday reserves the right to amend, update, or replace these Vendor Terms and Conditions at any time. Vendors will be notified of material changes through the platform or via registered email. Continued use of the platform following notification of changes constitutes acceptance of the revised terms.
16. Governing Law and Jurisdiction
These Vendor Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Please read these User Terms and Conditions carefully before using the Beli Holiday platform. By accessing or browsing beliholiday.com, you agree to be bound by these terms.
1. Introduction and Acceptance
These Terms and Conditions ("User Terms") govern your use of the Beli Holiday website and platform, accessible at beliholiday.com ("Platform"). By accessing or using the Platform, you ("User" or "Customer") agree to be bound by these terms in full.
Beli Holiday is a travel listing marketplace based in Malaysia, connecting users with registered travel agents, hoteliers, and homestay operators. Beli Holiday serves strictly as a listing platform and does not process payments, handle bookings, or act as a travel agent or tour operator.
If you do not agree to these terms, please discontinue use of the Platform immediately.
2. Nature of the Platform
Beli Holiday is a listing and advertising platform only. It provides a directory of travel products and packages offered by third-party vendors. The Platform is designed to help users discover travel options and connect with vendors directly.
Beli Holiday does NOT:

Process, handle, or facilitate any booking payments.

Accept or hold funds on behalf of vendors or customers.
-
Make or confirm bookings on behalf of any vendor.

Set or influence the pricing of any product or package listed.
-
Guarantee the availability, quality, accuracy, or suitability of any listed product.

Mediate, investigate, or resolve disputes between customers and vendors.

Verify or guarantee the completeness or accuracy of vendor-submitted listing information.
3. Vendor Verification
Beli Holiday performs verification checks on all vendors prior to listing them on the Platform. These checks are conducted to establish a reasonable baseline of legitimacy and compliance with Malaysian regulations. However, please note the following important limitations:

Vendor verification does not constitute an endorsement, recommendation, or guarantee of any vendor's services, packages, quality, or reliability.

Verification is based on documents provided by vendors and Beli Holiday cannot independently guarantee the ongoing validity of such documents.

It is your responsibility as a user to conduct your own due diligence before engaging with any vendor.
4. Listings and Information
All listings, package descriptions, itineraries, pricing, inclusions, exclusions, images, and other content displayed on the Platform are submitted entirely by vendors themselves. Beli Holiday does not create, curate, edit, or independently verify the accuracy or completeness of any vendor-submitted listing content.
Therefore, Beli Holiday:

Does not guarantee the accuracy, completeness, or currency of any listing information.

Does not warrant that listed prices are final or that packages are available at the stated price.

Is not responsible for any discrepancy between listed information and the actual product or service delivered by a vendor.
You are strongly advised to confirm all details, pricing, inclusions, terms, and availability directly with the vendor before making any booking or payment.
5. Bookings and Payments
All bookings and payments are conducted entirely between you and the vendor, outside of the Beli Holiday platform. Beli Holiday is not a party to any transaction between you and a vendor.
Important reminders regarding bookings and payments:

Beli Holiday does not process, collect, or hold any payments on your behalf.

Always request an official receipt or booking confirmation from the vendor.

Ensure that payment terms, cancellation policies, and refund conditions are clearly agreed upon with the vendor before making payment.

Exercise caution when making advance payments and consider requesting payment via traceable methods.

Beli Holiday cannot assist in recovering funds or resolving payment disputes.
6. Communication with Vendors
Upon viewing a listing of interest, you will be directed to communicate with the vendor directly through WhatsApp or, in the case of hotel and resort brands, you may be redirected to the vendor's official brand landing page for further details and enquiries.
All communication, negotiation, and agreement between you and a vendor takes place entirely outside the Beli Holiday platform. Beli Holiday has no visibility of, responsibility for, or involvement in any such communications.
Please ensure that all key terms, pricing, inclusions, and conditions are confirmed and agreed upon in writing with the vendor before proceeding with any booking or payment.
7. Product Categories Available
Beli Holiday lists travel products and services across the following categories:

Inbound Travel Packages — Tours and experiences within Malaysia for visiting travellers.

Outbound Travel Packages — Tours and holiday packages to international destinations.
-
Ticketing — Flight tickets, event tickets, attraction entries, and transportation services.

Umrah Packages — Umrah pilgrimage packages offered by accredited operators.

Hotel and Resort Listings — Accommodation offers and promotions from hotels and resorts in Malaysia.

Homestay Listings — Accommodation options from registered homestay operators.
8. Disclaimers and No Warranties
The Platform and all information provided on it are offered on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied. Beli Holiday expressly disclaims all warranties, including but not limited to:

Any warranty that the Platform will be continuously available, error-free, or free from viruses or harmful components.

Any warranty as to the accuracy, reliability, completeness, or timeliness of any listing or content on the Platform.

Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
9. Disputes and Complaints
Beli Holiday does not handle, mediate, or arbitrate any dispute, complaint, misunderstanding, or disagreement between users and vendors. All disputes arising from any transaction, booking, payment, service failure, or communication must be resolved directly and exclusively between you and the relevant vendor.
If you have a complaint about a vendor or a purchased product or service, you must:

Contact the vendor directly through the contact details provided in the listing or through your WhatsApp communication thread.

Retain all records of your communications, booking confirmations, receipts, and payment evidence.

If your complaint remains unresolved, you may consider escalating the matter to the relevant Malaysian consumer protection authority or regulatory body.
Beli Holiday cannot and will not intervene in vendor-customer disputes and will not be held responsible for any outcome of such disputes.
10. Limitation of Liability
To the fullest extent permitted by applicable Malaysian law, Beli Holiday, its directors, officers, employees, and agents shall not be liable for any loss, damage, or harm arising from:

Your use of or reliance on any listing, information, or content on the Platform.

Any transaction, booking, payment, or agreement between you and a vendor.
-
Any failure by a vendor to deliver services as advertised.
-
Any dispute, miscommunication, or misrepresentation between you and a vendor.

Any interruption, suspension, or unavailability of the Platform.

Any loss of funds, data, opportunity, or reputation arising from your use of the Platform.
Beli Holiday's role is limited to providing a listing platform. You access the Platform and engage with vendors entirely at your own risk.
11. User Responsibilities
As a user of the Platform, you agree to:

Use the Platform lawfully and in accordance with these terms.

Conduct your own due diligence on vendors before making any booking or payment.

Not use the Platform for any fraudulent, misleading, or unlawful purposes.

Not engage in conduct that could damage the Platform's reputation or disrupt its operation.

Verify all listing details directly with the vendor before committing to any purchase.
12. Privacy and Data Protection
Beli Holiday collects and processes user data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia. Any personal information you provide through the Platform will be used solely for the purposes of platform operation and, where applicable, to facilitate your connection with vendors.
Beli Holiday will not sell your personal data to third parties for commercial purposes without your consent, except as required by law or as necessary for the operation of the Platform.
Please note that any personal data you share directly with vendors via WhatsApp or other external channels is governed by the vendor's own privacy practices and is outside Beli Holiday's control.
13. Third-Party Links and Redirections
The Platform may redirect you to third-party websites, including hotel and resort brand landing pages, for further information and booking enquiries. Beli Holiday has no control over and accepts no responsibility for the content, privacy practices, or reliability of any third-party websites.
Any visit to a third-party website is at your own risk and is governed by that website's own terms and conditions and privacy policy.
14. Amendments to These Terms
Beli Holiday reserves the right to amend, update, or replace these User Terms at any time without prior notice. Changes will be effective upon posting to the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the updated terms.
15. Governing Law and Jurisdiction
These User Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.
